DramaSavor Terms of Service

Effective Date: September 30, 2026

1. INTRODUCTION AND ACCEPTANCE OF THESE TERMS

1.1 Welcome to DramaSavor, a short-drama and audiobook streaming application operated by TAIMI TECHNOLOGY (HK) CO., LIMITED, a company incorporated under the laws of the Hong Kong Special Administrative Region ("Company", "we", "us" or "our").

1.2 These Terms of Service, our Privacy Policy and our Content Guidelines, the applicable in-app product and plan details described in Sections 5.5 and 8, and any applicable Supplemental Terms disclosed to you (collectively, the "Terms") form the agreement between you and us governing the DramaSavor mobile application, website and related services (the "Service"). Our Privacy Policy explains how we process personal data; agreeing to these Terms does not replace any separate consent required by law. Additional product, territory or Offer terms apply only within their stated scope and subject to applicable acceptance requirements.

1.3 BY ACCESSING OR USING THE SERVICE, OR BY CREATING AN ACCOUNT, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

1.4 The Service is offered in English. If we provide translated versions of these Terms for convenience, the English version will prevail in the event of any inconsistency, except where local law requires otherwise. The same applies to translated or localized versions of the Service interface, in-app notices, product descriptions and marketing materials. Where the law of your country or territory of residence requires a local-language version to prevail for consumer protection purposes, that requirement prevails over this Section.

2. IMPORTANT NOTICE AND MANDATORY CONSUMER RIGHTS

2.1 Please read these Terms carefully. They impose responsibilities for your account, purchases, User Content and conduct, restrict refunds under Section 9, and contain exclusions and limitations subject to mandatory law. Section 19 PROVIDES FOR BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY HKIAC IN HONG KONG AND A WAIVER OF CLASS, COLLECTIVE AND REPRESENTATIVE PROCEEDINGS, subject to the exceptions and mandatory consumer rights stated there.

2.2 Nothing in these Terms deprives you of any right or remedy that cannot lawfully be waived or excluded under the mandatory consumer protection laws of your country or territory of residence, including (where applicable) the right to bring proceedings in your local courts.

3. ELIGIBILITY AND AGE REQUIREMENT (18+)

3.1 The Service is strictly for adult consumers. You must be at least eighteen (18) years old (or the age of majority in your country or territory of residence, whichever is higher) to register, access or use the Service. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly collect personal information from, or provide the Service to, any person under the age of 18. You must have full legal capacity and authority to enter into a binding agreement and must not be barred from receiving the Service under the laws of any applicable jurisdiction.

3.2 The Service is not directed to minors. You must not register or use the Service if you are under 18. If we learn that a user is ineligible, we may suspend or terminate the account and handle related personal data in accordance with our Privacy Policy and applicable law. Termination does not itself entitle the user to a refund; Section 9 applies.

3.3 You may not use another person's account, permit any other person (including a minor) to use your account, or create more than one account per person. Accounts are personal, non-transferable, and may not be sold, lent, gifted, or traded.

4. GEOGRAPHIC AVAILABILITY

4.1 The Service is made available only in territories where we have chosen to offer it, and we do not accept users domiciled, resident, or located in any territory where the Service is not offered.

4.2 We may use geo-filtering and other technologies to restrict access from territories where the Service is not offered, and content libraries may vary by territory due to licensing and distribution rights. We reserve the right to suspend or terminate any account that we reasonably believe is accessed from or associated with a territory where the Service is not offered, without refund.

4.3 If you choose to access the Service from any territory outside those where we offer it, you do so on your own initiative and are solely responsible for compliance with all local laws. You represent that your use of the Service is lawful under the laws of your jurisdiction.

5. THE SERVICE

5.1 The Service offers licensed short drama episodes and audiobooks. Availability of specific titles, episodes, or features may vary over time and by territory, and we do not guarantee that any particular title or episode will remain available or that future episodes of a serialized work will be published on any schedule. We make no guarantee that future episodes of any work will be posted or updated in a timely manner.

5.2 The Service may be accessed through: (a) free episodes or content we designate as free; (b) VIP subscription; and (c) Coins and Bonus, each as described in Section 8. We may change the free, ad-supported, or paid allocation of any content at any time.

5.3 Offers and Promotions. We may offer product groups or bundles, first-purchase or first-top-up incentives, retention or win-back offers, subscription discounts, trials, Bonus campaigns and Premium or Early Access offers ("Offers"). The relevant Offer terms specify the included items, price, eligibility, period, limits, redemption requirements and any ongoing subscription price. You must satisfy those conditions and must not combine or repeat Offers unless permitted.

5.4 Offer terms. Offer-specific terms prevail for their stated subject matter to the extent of a conflict with these Terms, subject always to mandatory law and Section 9.8. Offers may be changed or withdrawn prospectively; an accepted purchase remains governed by its agreed terms. An Offer does not enlarge VIP benefits unless it expressly provides a separately identified additional entitlement.

5.5 In-app product details. The relevant in-app membership, product, Offer and purchase pages will clearly describe the specific features, benefits, access entitlements, duration and material restrictions applicable to a product or plan before purchase or activation. Those details, as disclosed and accepted at that time, form part of the applicable transaction. You must review them before confirming your selection. They supplement these Terms without overriding Section 8 or any mandatory consumer protection.

5.6 Updates to features and plans. We may introduce, modify or discontinue features, plans and benefits and update the relevant in-app pages without revising these Terms, provided the update is consistent with these Terms and applicable law. Updated details apply prospectively to new purchases and, where permitted, future subscription renewals after any required notice and consent. Updating a page does not of itself retrospectively alter an existing purchase or the agreed benefits for a current paid subscription period. Material reductions to an existing entitlement remain subject to the applicable notice and consent requirements. Changes to these Terms themselves are governed by Section 18.

5.7 Promotional campaigns. From time to time we may run contests, sweepstakes, lucky draws, referral programmes, check-in or watch-to-earn campaigns, and other promotions ("Campaigns"). Each is governed by these Terms and by the Campaign rules published in the Service, which state eligibility, entry period, entry limits, prizes or Bonus awarded, how winners are selected and notified, and any restrictions.

(a) Where required by applicable law, no purchase is necessary to enter or win, and an alternative method of entry will be provided.
(b) Campaign rules prevail over these Terms only as to their stated subject matter and only to the extent they do not reduce a right you have under mandatory law.
(c) Bonus, Coins or other rewards awarded through a Campaign have no cash value and are subject to Section 8.
(d) You are responsible for any tax arising from a prize you receive, except where applicable law requires us to withhold or report it.
(e) We may modify, suspend or cancel a Campaign, and disqualify entries that breach these Terms or the Campaign rules, where reasonably necessary to prevent fraud, to comply with law, or for legal or technical reasons.

6. ACCOUNTS AND USER RESPONSIBILITIES

6.1 Registration and security. You must provide accurate, current and complete information, keep it updated, safeguard your credentials and secure the devices through which you access the Service. You are responsible for activity you authorise and for losses attributable to your breach of these obligations, subject to mandatory law. Notify us promptly if you suspect unauthorised access or use.

6.2 You must not share your account or credentials with any other person. We may limit the number of devices that can be logged in to the same account concurrently, and may verify account ownership; if verification fails, we may refuse to provide further access.

6.3 Accounts are for personal, non-commercial use only. You may not monetize your use of the Service, sell access, or engage in any reselling or commercial exploitation of the Service or content.

6.4 Your equipment and purchases. You are responsible for maintaining compatible devices and connectivity, installing necessary updates, reviewing the purchase terms and using the correct account and authorised purchase channel. You must not knowingly permit unauthorised charges or allow another person to use your payment credentials through the Service.

6.5 Cooperation. You must respond honestly to reasonable account, payment or rights-verification requests and provide only information you are authorised to disclose. You must not conceal abuse, fabricate evidence or exploit an error after becoming aware of it.

6.6 Compliance. You must comply with the Content Guidelines and lawful access restrictions and must not authorise or assist another person to do anything these Terms prohibit. Your responsibilities remain subject to rights and liabilities that cannot lawfully be excluded or altered.

6.7 Account identifiers. Your account name and other identifiers you adopt within the Service remain our property. They must not impersonate any person or entity, infringe any right, or breach our content standards. We may reclaim, disable or reassign an identifier, including after account closure, without compensation, subject to applicable law and Section 9.8.

7. CONTENT LICENSE AND RESTRICTIONS

7.1 Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view or listen to content made available through the Service, solely for your personal, non-commercial use, on devices and through interfaces we support.

7.2 The Service and its content are licensed, not sold. A purchase grants only the contractual access or usage entitlement described in these Terms and at the point of sale. It does not transfer intellectual property ownership in content, Coins, Bonus or other virtual items.

7.3 Except to the extent expressly permitted by us or by rights that cannot lawfully be restricted, you must not, and must not attempt to:

(a) copy, reproduce, record, download (other than transient caching by the Service), redistribute, sell, rent, lease, lend, sublicense, or publicly perform or display any content;
(b) create derivative works from, translate, or adapt any content;
(c) circumvent or disable any digital rights management, access control, paywall, or technical protection measure;
(d) access content by any means other than the Service's official software and interfaces;
(e) scrape, crawl, or harvest the Service by automated means, or collect data about other users;
(f) use the Service, any content, or any outputs derived from the Service or content to train, fine-tune, or improve any artificial intelligence or machine-learning model;
(g) use the Service for any commercial, promotional, or profit-making purpose; or
(h) remove any proprietary notices or markings.

7.4 We may revoke the license granted in Section 7.1 if you breach these Terms.

8. VIP SUBSCRIPTION, COINS AND BONUS

8.1 Paid features and in-app terms. We may offer paid features through the Service, including recurring VIP subscription plans, paid virtual credits ("Coins") and promotional credits ("Bonus") (together, "virtual currency"). The specific features, benefits, entitlements, prices, billing periods, renewal terms, redemption mechanics, expiry (if any) and material restrictions applicable to any product are those described on the applicable in-app membership, product, Offer and purchase pages at the time of purchase or activation, and form part of these Terms under Section 5.5.

8.2 Nature of virtual currency. Coins are purchased with money through an authorised channel; Bonus is granted without a separately stated monetary price. Virtual currency is a limited, personal, revocable, non-transferable, non-sublicensable licence to use virtual items within the Service. It is not legal tender, has no cash value, may not be sold, gifted, exchanged or redeemed outside the Service, and is non-refundable except as required by law or as expressly stated in Section 9.

8.3 Premium Content. Certain designated content ("Premium Content"), including content we designate as "Early Access", requires Coins or Bonus to unlock and is not included in any VIP Plan. An active VIP Plan does not waive or discount the separate cost of Premium Content, and later availability of that content on other terms does not itself entitle you to a refund, subject to Section 9.8.

8.4 Changes to paid features. We may introduce, modify or discontinue VIP benefits, virtual currency, redemption mechanics and Premium Content, and update the relevant in-app pages, on a prospective basis without revising these Terms, subject to Section 5.6, Section 18 and applicable law.

8.5 Account closure. Upon termination or deletion of your account, unused Coins and Bonus are forfeited and are not refundable or transferable, subject to Section 9.8 and Section 17.5.

9. PAYMENTS, TAXES, AND REFUNDS

9.1 Prices and authorisation. Before confirming a purchase, you must check the selected product, quantity, currency, total price, applicable taxes, access restrictions and any recurring charge. You represent that you are authorised to use the payment method and authorise the disclosed charge. You are responsible for applicable taxes and any charges imposed by your bank or payment provider, as disclosed or required by law.

9.2 Final purchases. SUBJECT TO Section 9.8, ALL PURCHASES AND PAYMENTS ARE FINAL AND NON-REFUNDABLE, INCLUDING VIP FEES, COINS, INDIVIDUAL EPISODE OR CHAPTER UNLOCKS, PREMIUM CONTENT, EARLY ACCESS AND PAID OFFERS. UNUSED OR PARTIALLY USED PURCHASES ARE NOT REFUNDABLE, EXCHANGEABLE, TRANSFERABLE OR REDEEMABLE FOR CASH MERELY BECAUSE YOU HAVE NOT USED THEM.

9.3 No change-of-mind refunds. Subject to Section 9.8, we do not provide refunds or credits because you change your mind, make an unintended selection, fail to cancel an authorised renewal, use only part of a subscription, do not spend your Coins, no longer wish to access a title, or stop using or delete the Service or your account. Dissatisfaction with a storyline, a later discount, or a mistaken assumption that VIP includes Premium or Early Access Content does not itself create a refund entitlement where the relevant terms were accurately disclosed. These exclusions do not determine whether a charge was legally authorised.

9.4 Billing queries. You should report a suspected billing error promptly and, where possible, within thirty (30) days, supplying the order reference, purchase channel and supporting details reasonably required to verify the transaction. This administrative request does not shorten any mandatory claim period. Submitting a query or refund request does not by itself establish eligibility for a refund.

9.5 Discretionary exceptions. We may, but are not obliged to, approve a goodwill refund or credit where no refund is otherwise required. Any such exception is assessed individually and does not establish a continuing policy, precedent or entitlement for other transactions. No fixed response, resolution or processing time is promised under these Terms.

9.6 Effect of reversals. Where a refund, payment reversal or chargeback is validly processed, we may revoke the corresponding access and reverse the associated Coins, Bonus or promotional benefits to prevent duplicate recovery. A voluntary reversal of a Coin-funded unlock may be made by restoring the relevant credits; this does not replace a monetary refund required by mandatory law. We may investigate dishonest or duplicate claims, but a good-faith exercise of statutory or payment-dispute rights is not itself abuse.

9.7 Purchase channels. App-store purchases are subject to the applicable store terms and mandatory refund policies. Submit a refund request through the relevant store process where that process applies; direct-purchase queries may be sent to the contact in Section 21. Refund eligibility and processing remain subject to the applicable purchase channel and Section 9.8.

9.8 Mandatory rights. Nothing in these Terms excludes, restricts or waives any consumer right or remedy that cannot lawfully be excluded, including any applicable right of withdrawal, cancellation or refund, or overrides a binding refund requirement of the purchase channel. This paragraph prevails over every inconsistent provision of these Terms and any incorporated product, plan or Offer details.

9.9 Immediate supply. Where immediate supply during a statutory withdrawal period requires separate express consent or acknowledgement, that consent or acknowledgement must be obtained through the applicable purchase flow. Acceptance of these Terms alone does not waive a statutory withdrawal right.

9.10 Failed payments. If a payment is rejected, declined or returned unpaid for any reason, we may suspend or withhold the relevant access until the payment is processed successfully, without prejudice to any right you have under the applicable purchase channel.

9.11 Reversals and chargebacks. You remain liable for the disclosed price of a validly reversed purchase, and for reasonable fees we incur as a result of a reversal, chargeback or failed payment, where applicable law permits us to pass them on and they were disclosed to you. We will not charge such fees where your payment channel’s rules or mandatory law prohibit it. A good-faith exercise of a statutory or payment-dispute right is not a breach of these Terms.

10. USER CONTENT, COMMENTS, AND FEEDBACK

10.1 The Service may allow you to post comments, reviews, ratings, and similar materials ("User Content"). You retain ownership of your User Content.

10.2 You grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to host, reproduce, adapt, publish, translate, display, and otherwise use your User Content in connection with operating, improving, and promoting the Service. Where permitted by law, you waive (or agree not to assert) moral rights in your User Content.

10.3 If you wish to keep any content private or proprietary, do not submit it. Once submitted, User Content is not confidential, and we are not obliged to return or preserve it.

10.4 Your responsibility. You represent and warrant that you own or have all necessary rights, permissions and consents to submit your User Content and grant the licence in Section 10.2; that it is lawful and does not infringe intellectual property, privacy, publicity or other rights; and that it complies with the Content Guidelines. You are responsible for its accuracy where presented as fact and for your own statements and conduct. We may review, restrict, remove or refuse User Content for breach of these Terms, applicable law or our disclosed content standards.

10.5 If you send us ideas, suggestions, or feedback, you grant us the same license as in Section 10.2, free of any obligation or compensation.

10.6 User cooperation and records. You must not submit confidential material or another person’s sensitive information without a lawful basis and all necessary permissions. You are responsible for keeping any copy of your User Content you wish to retain and for cooperating reasonably with a substantiated rights or safety inquiry. The Content Guidelines set out the applicable reporting and appeal routes.

11. INTELLECTUAL PROPERTY AND INFRINGEMENT CLAIMS

11.1 The Service and all content, software, trademarks, and materials are owned by us or our licensors. All rights not expressly granted are reserved. No license is granted by implication, estoppel, or otherwise.

11.2 If you believe content available through the Service infringes your copyright or other intellectual property rights, send a notice to our designated agent (Section 21) including:

(a) identification of the work claimed to be infringed;
(b) the material you claim is infringing and its location;
(c) your contact information;
(d) a statement of your good-faith belief;
(e) a statement, under penalty of perjury (or under the standard applicable in your jurisdiction), that the information is accurate and that you are the rights holder or authorized to act; and
(f) your physical or electronic signature.

11.3 If your content was removed as a result of such a notice and you believe the removal was mistaken, you may submit a counter-notice. We may, at our discretion, restore content after a valid counter-notice, subject to applicable law.

11.4 Where reasonably necessary and lawful to assess or pursue an infringement complaint, we may disclose relevant account, identity or contact information to the complaining rights holder or competent authorities in accordance with our Privacy Policy and applicable law. You must cooperate reasonably with verification requests. This clause does not waive non-excludable privacy rights or authorise disclosure merely because an unsupported allegation has been made.

11.5 We reserve the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers, or of any user upon a single serious infringement.

11.6 Repeat-infringer policy. In deciding whether to terminate an account under Section 11.5, we consider the number and seriousness of substantiated notices; a single serious infringement may also justify termination. Infringement notices and counter-notices may be submitted through the channels identified in Section 21. Terminating an account under this Section may also involve removal of the associated content and, where lawful, refusal of further accounts by the same person.

12. PROHIBITED CONDUCT

12.1 You must not:

(a) breach these Terms or any policy referenced in them;
(b) harass, abuse, defame, threaten, or harm other users or our staff;
(c) upload or transmit unlawful, infringing, obscene, fraudulent, or malicious content, including malware;
(d) interfere with or disrupt the Service, servers, or networks, including denial-of-service attacks;
(e) access the Service through unofficial clients, emulators, or modified software;
(f) create accounts by automated means; maintain multiple accounts to abuse promotions, rewards, or free trials; or sell, buy, or trade accounts;
(g) abuse refunds, reward campaigns, or promotional mechanics;
(h) impersonate any person or entity; or
(i) violate any applicable law or regulation.

12.2 We may investigate suspected violations and cooperate with law enforcement. Breach may result in warnings, removal of content, adjustment of balances, suspension, termination, and reporting to authorities.

12.3 Responsibility for breach. You are responsible for your own breach and its legally recoverable consequences, including the indemnity in Section 16 where applicable. Enforcement under this Section does not authorise an undisclosed financial penalty or limit any non-excludable right.

13. THIRD-PARTY PLATFORMS AND LINKS

13.1 The Service may contain links to, or integrations with, third-party platforms (including app stores, and payment providers) that are not controlled by us. We are not responsible for third-party content, products, or services.

13.2 Your use of app stores is additionally governed by the relevant store's terms.

14. DISCLAIMER OF WARRANTIES

14.1 THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

14.2 WE DO NOT WARRANT THAT: (A) THE SERVICE OR ANY CONTENT WILL BE AVAILABLE AT ALL TIMES OR IN ALL TERRITORIES; (B) ANY PARTICULAR TITLE OR EPISODE WILL REMAIN AVAILABLE; (C) FUTURE EPISODES WILL BE PUBLISHED ON ANY SCHEDULE; OR (D) THE SERVICE WILL BE FREE OF BUGS, ERRORS, OR HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR SOLE RISK.

14.3 Nothing in these Terms excludes or limits warranties or remedies that cannot lawfully be excluded, including under the Control of Exemption Clauses Ordinance (Cap. 71) and the Supply of Services (Implied Terms) Ordinance (Cap. 457) of Hong Kong, or under the mandatory law of your jurisdiction (including statutory consumer guarantees).

15. LIMITATION OF LIABILITY

15.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING FROM OR RELATING TO THE SERVICE.

15.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US THROUGH THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

15.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or any other liability that cannot lawfully be excluded, including under the Control of Exemption Clauses Ordinance (Cap. 71) of Hong Kong.

15.4 Events outside our control. THIS Section 15.4 IS SUBJECT TO Section 15.3. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY LOSS, INTERRUPTION OR FAILURE CAUSED BY ANY OF THE FOLLOWING:

(A) ANY COMPUTER VIRUS, TROJAN, RANSOMWARE OR OTHER MALICIOUS CODE, OR ANY UNAUTHORISED ACCESS TO OR ATTACK ON OUR SYSTEMS OR ON ANY THIRD-PARTY SYSTEM WE RELY ON;
(B) ANY MALFUNCTION, FAILURE, DELAY OR UNAVAILABILITY OF SOFTWARE, SYSTEMS, HARDWARE, NETWORKS OR CONNECTIVITY, WHETHER OPERATED BY US, BY YOU OR BY A THIRD PARTY, INCLUDING CONTENT DELIVERY, HOSTING AND PAYMENT;
(C) YOUR FAILURE TO SAVE OR BACK UP ANY DATA OR CONTENT.

16. INDEMNIFICATION

16.1 To the extent permitted by applicable law, you agree to indemnify and hold harmless TAIMI TECHNOLOGY (HK) CO., LIMITED and its affiliates, officers, employees and agents against third-party claims, liabilities and reasonable losses and legal costs to the extent caused by your breach of these Terms, your unlawful or infringing User Content, or your violation of applicable law or third-party rights. This obligation does not extend to loss caused by our own negligence, wilful misconduct or breach, or impose liability that cannot lawfully be imposed on a consumer.

16.2 We may take control of the defence of a claim covered by Section 16.1 and you must reasonably cooperate. We will give you reasonable notice of the claim where practicable. You must not settle a claim in a way that admits liability on our behalf or imposes obligations on us without our written consent; we will not agree a settlement imposing non-monetary obligations or an admission on you without your consent.

17. TERM, SUSPENSION, AND TERMINATION

17.1 These Terms apply from your first use of the Service until terminated.

17.2 You may stop using the Service and request account deletion at any time. You must separately cancel any recurring subscription through its purchase channel. You are responsible for considering the effect of deletion on your access and unused balances before confirming it. Deletion does not itself entitle you to a refund; Section 9 applies.

17.3 We may suspend or terminate your account or access, with or without prior notice, if: (a) you breach these Terms; (b) we are required to do so by law or by an app store or regulatory authority; (c) your conduct exposes us or others to legal, financial, or security risk; or (d) your account has been inactive for one (1) year or more, where permitted by law.

17.4 Upon termination: (a) your licence ends; (b) unused Coins and Bonus are forfeited subject to Sections 8.5 and 9.8; (c) access to Premium Content ends; and (d) provisions which by their nature should survive remain effective to the extent applicable, including accrued payment obligations and Sections 7, 8, 10–13, 15–17 and 20–21.

17.5 Financial consequences. Suspension, termination or account deletion does not, of itself, give rise to a refund, credit or compensation. The restrictions and exceptions in Section 9 apply. Nothing in this Section permits forfeiture or retention of amounts where mandatory law or a binding purchase-channel rule requires otherwise.

18. CHANGES TO THESE TERMS

18.1 We may update these Terms. We will publish the updated version in the Service and indicate the effective date.

18.2 For material changes that reduce your rights or increase your obligations, we will provide notice through the Service or by other reasonable means. If you do not accept the change, you may stop using the Service and cancel your subscription before the effective date.

18.3 Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may close your account. Disputes arising before the effective date are governed by the version in force at the relevant time.

19. GOVERNING LAW AND DISPUTE RESOLUTION

19.1 Governing law. These Terms and any dispute or non-contractual obligation arising out of or in connection with them are governed by the laws of Hong Kong. This choice does not deprive you of mandatory consumer protections applicable under the law of your habitual residence. References to Hong Kong mean the Hong Kong Special Administrative Region of the People’s Republic of China.

19.2 Informal resolution. Please contact us under Section 21 to seek an informal resolution of a dispute. This does not prevent urgent relief, suspend a statutory limitation period or make an informal complaint a condition of exercising a non-excludable right.

19.3 Arbitration. Subject to Sections 19.5 and 19.6, any dispute arising out of or in connection with these Terms or the Service, including their existence, validity, interpretation, performance, breach or termination and related non-contractual obligations, shall be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong. The tribunal shall consist of one arbitrator and the language shall be English. This arbitration agreement is governed by Hong Kong law. The award shall be final and binding, subject to any review or challenge permitted by applicable law. Costs shall be determined under the applicable rules and mandatory law.

19.4 Class action waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WE AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION OR ARBITRATION CONCERNING SUCH A DISPUTE. TO THAT EXTENT, THE TRIBUNAL MAY NOT CONSOLIDATE DIFFERENT USERS’ CLAIMS OR CONDUCT A CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. THIS RESTRICTION APPLIES NOTWITHSTANDING ANY CONSOLIDATION OR JOINDER PROVISION OF THE APPLICABLE ARBITRATION RULES. IT DOES NOT RESTRICT ANY NON-WAIVABLE RIGHT TO SEEK PUBLIC INJUNCTIVE RELIEF OR TO PARTICIPATE IN A PROCEEDING PROTECTED BY MANDATORY LAW. IF THIS WAIVER IS UNENFORCEABLE FOR A PARTICULAR CLAIM OR FORM OF RELIEF, THAT CLAIM OR RELIEF MAY PROCEED IN A COMPETENT COURT TO THE EXTENT REQUIRED BY LAW; OTHER SEVERABLE CLAIMS REMAIN SUBJECT TO ARBITRATION WHERE ENFORCEABLE.

19.5 Exceptions. Section 19.3 does not prevent either party from seeking urgent interim or injunctive relief from a competent court, bringing an individual claim within the jurisdiction of the Hong Kong Small Claims Tribunal or a competent small-claims or consumer tribunal in your place of residence, or applying to a competent court to recognise, enforce or challenge an award as permitted by law. Seeking such relief does not otherwise waive the arbitration agreement.

19.6 Mandatory consumer rights. Sections 19.3 and 19.4 apply only to the extent enforceable under applicable law. Nothing in these Terms excludes or restricts any non-waivable consumer right or remedy, including a right to bring proceedings in your local courts, access a statutory dispute mechanism or complain to a regulator. Mandatory rules concerning jurisdiction, arbitration consent, procedural fairness and costs prevail. Where arbitration cannot lawfully be required, the courts of Hong Kong shall have jurisdiction, subject to any mandatory right to use another competent forum and any mandatory restriction on proceedings against a consumer.

19.7 Any claim arising out of or relating to the Service must be brought within one (1) year after the cause of action arises, except where a longer limitation period applies under mandatory law.

20. GENERAL PROVISIONS

20.1 Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in force.

20.2 No waiver. Our failure to enforce any provision is not a waiver of that provision or right.

20.3 Assignment. You may not assign these Terms. We may assign or transfer these Terms (including in connection with a merger, acquisition, or sale of assets) with reasonable notice to you.

20.4 Force majeure. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, labor disputes, utility or internet failures, or acts of government.

20.5 Entire agreement. These Terms, including the applicable in-app product and plan details and policies incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede prior agreements concerning the same subject matter.

20.6 Notices. We may provide notices through the Service, email, or app-store messaging. You agree to receive electronic communications, and that such communications satisfy any legal requirement for writing.

20.7 Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) of Hong Kong to enforce any term of these Terms.
